These Terms of Service (“Terms”) apply to the contractual relationship between Witted Megacorp Oy (Business ID: 2778226-8) (“Witted”) and you (“you”) in relation to the use of Witted’s online portal available at app.witted.com (“Service”).
Witted and you herein each separately as a “Party” and both together as the “Parties”.
By consenting to these Terms you agree to be bound by these Terms.
The Service helps you connect with Witted’s selected partner companies that offer potential project assignments and/or employment opportunities (each separately a “Partner”, all together the “Partners”) by providing information on you and your professional skills to such Partners through Witted’s talent agents. Upon signing up for the Service and consenting to these Terms and the Privacy Policy of the Service you guarantee that you and your employees whose data is entered to the Service consent to the Privacy Policy of the Service and sharing of their data with their consent with Witted’s Partners whose projects and/or employment opportunities can be found from the Service. For more information on processing of personal data in the Service, see the Privacy Policy below.
Any assignment, employment or other contract with a Partner executed based on or related to the project assignments and/or employment opportunities offered in the Service and any other related terms shall be agreed on separately between you and Witted.
When consenting to these Terms, if you are representing an organization, you guarantee that you are represented by a person legally authorized to represent your organization and enter into legally binding commitments on behalf of your organization.
As Witted provides the Service to you for free, the Service is provided on an “as is” and “as available” basis without any warranties of any kind, express or implied. Witted may at its discretion update, modify, block and close the Service or a part of it.
You are responsible for your own devices, software, systems and connections you use to access the Service as well as their security. You agree not to cause errors, disruption or other damage to the Service, Witted, Partners or third parties.
The Service contains information concerning Witted’s Partners offering potential project assignments and/or employment opportunities. You agree not to disclose any such information concerning Witted’s Partners available in the Service or otherwise disclosed to you in context of discussions between you and Witted in relation to Witted’s Partners, customers or Witted’s business to third parties.
All rights, title and interest in and to the Service including its content belongs to Witted or a third party. You may not use, publish, modify, copy, distribute or otherwise utilize the Service or its content for other purposes than finding connecting with Partners without Witted’s prior consent. You may not sell, resell or otherwise offer the Service to be used by third parties without Witted’s prior consent.
Witted shall not under any circumstances be liable for any indirect, consequential or direct loss, damage or expenses in relation to the Service or these Terms.
If any term or provision of these Terms is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
The Terms shall enter in force when you accept them upon signing up to the Service and continue in force until terminated by either Party upon written notice to the other Party. Please note, however, that your use of the Service is subject to compliance with these Terms.
Obligations set out herein that shall continue in force after the termination of these Terms by their nature shall remain in force notwithstanding the termination of these Terms for any reason, such as but not limited to the obligations set out in Sections 2 and 3.
Witted may amend these Terms at its discretion by notifying you thereof in the Service or by other applicable channels. By accepting the amended Terms or continuing the use of the Service you accept the amended Terms. Please note that you may at any point stop using the Service and close your account upon written notice to Witted.
These Terms are governed by and shall be construed in accordance with the laws of Finland without regard to its choice of law provisions.
Any dispute, controversy or claim arising out of or relating to these Terms, or the breach, termination or validity thereof, shall be finally settled by arbitration in accordance with the Arbitration Rules of the Finland Chamber of Commerce. The number of arbitrators shall be one. The seat of arbitration shall be Helsinki, Finland. The language of the arbitration shall be Finnish.

The data you have provided to the Service will be shared with such Witted’s selected partner companies that offer potential project assignments and/or employment opportunities when you have given your consent to it.
Along with your consent, Witted has a legitimate interest to process the above listed personal data for the purposes described above.
We store the data collected in connection with the Service for no longer than is needed for the purposes stated in Section 3. We review the necessity of our data regularly and erase data when it is no longer needed.
You may always request us to erase your data and after such a request we will erase your data. However, we may retain your data we already have as long as it is required for billing purposes and taking care of our contractual duties in relation to you and our Partners or if it is expressly required by applicable laws or relevant authorities.
You have the right to request access to, erasing and correcting your personal data as held and processed by Witted, as well as to send us any other requests based on then applicable data protection laws (e.g. request restriction of processing of the data). Further, you always have the right to prohibit us from sending marketing messages to you. Please send any requests concerning your data to the email addresses set out above in Section 2.
Data protection laws are supervised in Finland by the Finnish Data Protection Ombudsman. If you have questions belonging to the jurisdiction of the Data Protection Ombudsman, or if you wish to lodge a complaint regarding processing of personal data, you may contact the Data Protection Ombudsman’s office as instructed at www.tietosuoja.fi.
We consider all personal data we collect to be confidential. Your data can only be accessed by the Witted employees when it is necessary for them to perform their work related to your data and the Service. Further, your data will be shared with our partner companies when you have given your consent to this beforehand.
The network and equipment of Witted has been secured by using appropriate measures to protect the personal data against unauthorized access and accidental or unlawful destruction, alteration, disclosure, transfer or other unlawful forms of processing.
We may outsource our processing of personal data to external service providers. In such events we enter into appropriate agreements with the providers in order to ensure that your personal data is processed confidentially and in accordance with this Privacy Policy and any applicable laws.
We may update this Privacy Policy as we improve our Service and operations. The updated notice will be made available on our website.
